These Terms and Conditions of Use (“Terms”) govern the access to and use of the agecheck.pro software (the “Service”), operated by DevScope LLC, a Limited Liability Company incorporated under the laws of the State of Delaware, United States of America (“DevScope,” “we,” “our”). The Service is intended exclusively for business clients (B2B). It is not directed at end consumers or individuals acting in a personal capacity.
1. ACCEPTANCE OF TERMS
By accessing, integrating, using, or paying for the Service, the client (“Client”) represents and warrants that:
- It has the legal capacity to enter into binding agreements.
- It is acting on behalf of a legal entity.
- It has read, understood, and accepted these Terms in their entirety.
If the Client does not agree to these Terms, it must not use the Service.
2. DESCRIPTION OF THE SERVICE
agecheck.pro is a software-as-a-service (SaaS) solution that provides automated age estimation using artificial intelligence technologies. The Client expressly acknowledges that:
- The Service is NOT a personal identification or Know Your Customer (KYC) system.
- The Service does NOT verify legal identities.
- All results are probabilistic in nature and not deterministic.
- Absolute accuracy and regulatory compliance are not guaranteed.
3. PERMITTED USE
The Client agrees to:
- Use the Service exclusively for lawful purposes.
- Comply with all applicable laws and regulations in its jurisdiction, including without limitation those governing alcohol, gambling, betting, tobacco, and adult content.
- Provide adequate notice and disclosure to its end users.
The following are expressly prohibited:
- Using the Service as the sole compliance measure where applicable law requires additional controls.
- Attributing any regulatory or legal liability to DevScope arising from the Client’s use of the Service.
4. CLIENT RESPONSIBILITY
The Client is solely and exclusively responsible for:
- Determining whether the Service is appropriate for its specific business activity.
- Correctly configuring all age-related parameters within the Service.
- Meeting all applicable legal and regulatory obligations.
DevScope assumes no responsibility for the manner in which the Client uses the Service.
5. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” DEVSCOPE LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- LEGAL OR REGULATORY COMPLIANCE
- NON-INFRINGEMENT
6. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:
DevScope LLC shall not be liable for any indirect, incidental, consequential, punitive, regulatory, or administrative damages of any kind, including without limitation fines, administrative penalties, third-party claims, loss of profits, or reputational harm.
The total aggregate liability of DevScope LLC under or in connection with these Terms shall not exceed the amounts actually paid by the Client in the thirty (30) days preceding the event giving rise to the claim.
7. INDEMNIFICATIONThe Client agrees to indemnify, defend, and hold harmless DevScope LLC and its officers, directors, employees, and agents from and against any claims, penalties, proceedings, damages, losses, or costs arising out of or in connection with:
- The Client’s use of the Service.
- Any breach of applicable law or regulation by the Client.
- Claims brought by end users or regulatory authorities against DevScope in connection with the Client’s use of the Service.
8. SUSPENSION AND TERMINATIONDevScope reserves the right to suspend or terminate access to the Service at any time, without prior notice, if it determines that the Service is being used in an improper, unlawful, or high-risk manner.
9. MODIFICATIONS
DevScope reserves the right to modify these Terms at any time, at its sole discretion. Continued use of the Service following the posting of any changes constitutes the Client’s acceptance of the revised Terms. Clients are encouraged to review these Terms periodically.
10. GOVERNING LAW AND JURISDICTION
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States of America. Any dispute arising out of or in connection with these Terms shall be submitted exclusively to the jurisdiction of the state or federal courts of Delaware.
